These General Terms and Conditions (hereinafter referred to as “Terms”) govern the use of the Packbag mobile application (iOS and iPadOS) and its website (together referred to as the “Service”). The Service Provider is TM Infotech Ltd., registered office at 9325 Sopronnémeti, Hunyadi Street 3/a, company registration number: 08-09-034842, tax number: 32053461-2-08, email: info@tm-it.hu, phone: +36 (21) 202-57-07 (hereinafter: “Provider”, “We”).
Please read these Terms carefully. By using the application, you (the “User”, “You”) agree to be bound by these Terms.
1. Definitions
Application / App: The Packbag iOS/iPadOS mobile application and its related website.
Service: The features provided by the Application and the information available on the website.
User Account: If registration is not required to use the Application, this term does not apply; if registration is required, the conditions for creating an account are governed by separate terms provided during registration.
2. Subject of the Agreement
These Terms regulate the legal conditions for using the Service, the rights and obligations of the parties, and the relationship between the Provider and the User regarding the Service usage.
3. Brief Description of the Service
Packbag is an iOS/iPadOS application providing functions such as packing management, list handling, reminders, etc., aimed at personal use (non-commercial packing support).
4. Data Handling and Privacy
Cloud and Data Transmission: Data you provide is not stored in the cloud, nor does the application transmit personal data to the Provider.
Local Storage: Data is stored solely on your device. You are responsible for accessing, backing up, and securing this data.
Third-Party Services: If in the future the Application uses third-party services (e.g., analytics, advertising), you will be notified separately, and details will be included in the Privacy Policy.
Privacy Policy: Detailed data handling principles and your rights can be found in the Privacy Policy available on the website.
Liability: The Provider is not responsible for data loss on your device caused by circumstances beyond our control (e.g., device loss, malfunction, system restore). We recommend you use your own backup solutions if data is important.
5. Terms of Use
Eligibility: Only legally competent individuals or their lawful representatives may use the Application.
Prohibited Activities: Using the Application for illegal purposes, violating others’ rights, disrupting or modifying the Application, reverse engineering, or unauthorized access is prohibited.
App Store Terms: Distribution on iOS/iPadOS is subject to Apple App Store policies, which the User also agrees to.
6. License and Intellectual Property
Provider’s Rights: All content of the Application and website, including software, logos, texts, images, and documentation, are owned by the Provider or rights holders and protected by copyright, trademarks, and other laws.
User License: The Provider grants a non-exclusive, non-transferable, personal, limited license to install and use the Application on your device. This license does not permit reverse engineering, modification, commercial distribution, or source code disclosure.
User Content: Content created by Users within the app (e.g., lists, descriptions) remains their copyright; however, the Provider may process or display it as needed for the service operation.
7. Fees and Payment
The Application is currently free / paid. If in-app purchases, subscriptions, or payments are introduced, their terms will be separately provided at the time of transaction. All payments follow App Store policies, including refund rules.
8. Warranty and Liability Limitations
Operation: The Provider strives for continuous availability but does not guarantee error-free or uninterrupted service or fulfillment of all user requirements.
Liability Limitation: The Provider is not liable for indirect damages, lost profits, data loss, or damages arising from using or inability to use the Service, except where mandatory law states otherwise. Direct liability per event is limited to the amount paid by the User for the Application in the last 12 months (if applicable). For free services, liability is limited.
Exceptions: This does not affect liability in cases of gross negligence, intentional misconduct, or mandatory consumer protection laws.
9. Updates and Maintenance
The Provider may update, improve, and maintain the Application from time to time. Updates install on your device and may require your consent or device configuration.
10. Third-Party Content and Links
The Application or website may include third-party content or links. The Provider is not responsible for third-party content and you access such external sites at your own risk.
11. Termination and Access Restriction
The Provider may immediately restrict or terminate access if the User seriously violates the Terms, engages in illegal activity, or infringes others’ rights. Termination does not affect existing claims.
12. Force Majeure
The Provider is not liable for events beyond its control and unforeseeable or unavoidable causes such as natural disasters, fire, power outages, network failures, government actions, war, terrorism, or third-party service outages.
13. Legal Enforcement and Dispute Resolution
Governing Law: Hungarian law applies to these Terms and Service use.
Consumer Disputes: If you are a consumer, applicable consumer protection laws govern dispute resolution. Complaints can be filed via the Provider’s contact details.
Court Jurisdiction: Non-consumer disputes are subject to the exclusive jurisdiction of the court in the Provider’s seat (Sopronnémeti / Győr-Moson-Sopron county), unless law specifies otherwise.
14. Amendments
The Provider reserves the right to amend these Terms from time to time. Users will be informed of significant changes via website publication or in-app notifications. Amendments take effect upon publication unless otherwise specified by law. Continued use of the Service constitutes acceptance of the updated Terms.

16. Final Provisions
If any provision of these Terms is invalid or unenforceable, it does not affect the validity of the remaining provisions. An enforceable provision in accordance with applicable law will replace the invalid one.
These Terms constitute the entire agreement between the parties regarding the Service and supersede any previous conflicting agreements.
